Hosting
The Service is hosted on cloud infrastructures located in the European Union and the United States, provided by:

• Hostinger International Ltd. – 61 Lordou Vironos Street, Lumiel Building, 4th floor, 6023 Larnaca, Cyprus (application hosting)
Data of users located in the European Economic Area is stored on servers located in the European Union (notably in Frankfurt, Germany, and Ireland). Data of users located outside the EEA may be stored in the United States or other regions worldwide, subject to appropriate safeguards in accordance with the GDPR (Standard Contractual Clauses) and other applicable data protection laws.

Intellectual Property
All components of the Service (source code, interface, texts, images, "FBA SELLER EXPERTS" trademarks, logos, modules, algorithms, documentation) are protected by copyright and trademark law in the United States (Copyright Act, 17 U.S.C. §§ 101 et seq.; Lanham Act, 15 U.S.C. §§ 1051 et seq.) and internationally (Berne Convention, WTO TRIPS Agreement).
Any reproduction, modification, distribution, decompilation, or reverse engineering, in whole or in part, is strictly prohibited without prior written authorization from FBA SELLER EXPERTS LLC. The user is granted only a personal, non-exclusive, non-transferable, and revocable right to use the Service.
Enhanced protection against unauthorized copying and extraction: It is expressly forbidden to copy, reproduce, extract, scrape, harvest, bulk download, decompile, disassemble, circumvent technical protection measures, or create derivative works from all or part of the Service, its source code, databases, application programming interfaces (APIs), or any other content accessible through the Service. Any attempt at unauthorized circumvention or extraction, including by automated means, constitutes a violation of FBA SELLER EXPERTS LLC's intellectual property rights and may result in civil and criminal legal proceedings, both in the United States and in foreign jurisdictions, in accordance with applicable laws, including the Digital Millennium Copyright Act (DMCA), EU Directive 2001/29/EC, and the Computer Fraud and Abuse Act (CFAA). FBA SELLER EXPERTS LLC reserves the right to block access, revoke usage rights, and claim damages for any proven violation.
The user remains the owner of all documents, data, images, and content they import or create through the Service. FBA SELLER EXPERTS LLC claims no ownership rights over such content, subject to a simple usage license limited to what is strictly necessary for the performance of the Service (hosting, display, processing).
Personal Data & Cookies
FBA SELLER EXPERTS is committed to processing your personal data in compliance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679), the UK GDPR, the California Consumer Privacy Act (CCPA), the Swiss Federal Act on Data Protection (FADP), Quebec's Law 25, the Brazilian LGPD (Lei Geral de Proteção de Dados), Japan's Act on the Protection of Personal Information (APPI), the Australian Privacy Act 1988, and any other applicable data protection law.

You have the following rights regarding your personal data: access, rectification, erasure (right to be forgotten), portability, restriction of processing, objection to processing, and withdrawal of consent. You also have the right to define directives regarding the fate of your data after your death. These rights may be exercised by writing to privacy@fbasellerexpert.com.

Strictly necessary cookies are used for the operation of the Service. No third-party advertising cookies are placed without your prior consent. You may manage your cookie preferences at any time via the cookie management panel accessible from the Service.
Subscriptions and Payment Terms
Subscriptions taken out through the Service are managed by a PCI-DSS Level 1 certified payment service provider. No credit card data is stored by FBA SELLER EXPERTS LLC.
The subscription is concluded for an initial period (monthly, quarterly, or semi-annual depending on the chosen plan). At the end of this period, it is automatically renewed by tacit agreement for the same duration, unless the user cancels before the renewal date. No cancellation may take effect during the current period.
The user may cancel their subscription at any time from their personal dashboard. Cancellation will take effect at the end of the current subscription period. No refund (even partial) is due for the period already commenced, unless otherwise required by mandatory applicable law.
As the Service is exclusively intended for professional use (B2B), the statutory withdrawal right provided by consumer law does not apply to subscriptions taken out by professionals. By subscribing, the user acknowledges acting in the course of their professional, commercial, industrial, artisanal, or liberal activity.
FBA SELLER EXPERTS LLC reserves the right to modify its pricing. Any price change will be notified to the user at least thirty (30) days before its effective date. The user may then cancel without charge before the new price takes effect.
In the event of a declined payment, access to the Service may be suspended without notice. Any bank fees remain the responsibility of the user.
Limitation of Liability – Use of the Service
FBA SELLER EXPERTS LLC uses its best efforts to provide a reliable Service that complies with applicable regulations in the jurisdictions where it is offered. However, to the fullest extent permitted by mandatory applicable laws, the company disclaims all liability in the following cases:
1. AI Expert Advice
Responses provided by artificial intelligence modules (Business, Legal, Accounting, Logistics Experts) are automatically generated by language models such as Groq Llama 3 70B/90B, DeepInfra, and any other model integrated into the Service. These responses are for informational purposes only and do not constitute professional, legal, tax, or accounting advice, whether in the United States, the European Union, or any other jurisdiction. Laws, regulations, and professional standards vary considerably from one country to another; the AI Experts' advice is not tailored to any specific jurisdiction. The user remains solely responsible for their decisions and must have such advice verified by a qualified human expert duly authorized in the relevant jurisdiction before taking any action.
2. Compliance Tools & Labels
Regulatory labels (CE, UKCA, TRIMAN, FCC, PSE, Green Dot, and any other mandatory marking), barcodes (EAN-13, UPC-12, SSCC GS1-128), and customs duty calculations (TARIC for the EU, HTS for the United States, and any other national customs tariff) are provided as a technical aid. These tools are based on regulations in force at the time of their last update, which may change at any time without notice. The accuracy of the results also depends on the information entered by the user. It is the user's responsibility to validate final product compliance with competent authorities (customs, market surveillance authorities, notified bodies) and their freight forwarders in each destination country. FBA SELLER EXPERTS LLC shall under no circumstances be held liable for customs clearance refusals, goods seizures, administrative or customs penalties, product recalls, fines, delivery delays, or any other direct or indirect damage arising from regulatory non-compliance.
3. FBA Simulator & Financial Analysis
The Profit Lab module and any other calculator integrated into the Service provide estimates based on fee schedules published by Amazon and other platforms at the time of calculation. These fees may be unilaterally modified by the relevant platforms without notice. Calculations may also vary due to data entry errors, special cases not covered by the algorithms (oversized products, special categories, loyalty programs), or exchange rate fluctuations for international transactions. The user must systematically cross-check results with their seller dashboard on the relevant platform. Under no circumstances do these estimates constitute a contractual commitment regarding the profitability of a product or business.
4. Gap Hunter & Sourcing
Product opportunities detected by the Gap Hunter module are based on market data from external sources (marketplaces, social networks, public databases). This data may not reflect the full extent of competition, demand, or barriers to entry (patents, licenses, specific standards) in a given market. The predictive score (0-100) is a statistical indicator and does not guarantee commercial success. The user assumes all financial risks associated with their investments, including operating losses, storage fees, and market withdrawal costs.
5. Cashflow & Stock Forecasts
The Cashflow & Stock module provides financial projections based on information provided by the user and standard assumptions (transport times, exchange rates, tax rates). These projections do not constitute financial advice within the meaning of applicable laws and regulations in the relevant jurisdictions (including the Investment Advisers Act of 1940 in the United States, the MiFID II Directive in the EU). They shall not engage the liability of FBA SELLER EXPERTS LLC in the event of stock shortages, loss of revenue, cash flow difficulties, or inaccuracy of forecasts.
6. Seller Reports
Reports generated from files extracted from Amazon and other platforms are intended for internal management analysis. They do not replace official accounting maintained in accordance with the accounting standards applicable in the user's country of establishment (US GAAP, IFRS, French PCG, German HGB, etc.). These reports must be reviewed by a duly qualified chartered accountant or certified public accountant (CPA) before any tax, social security, or regulatory declaration.
7. Service Availability
FBA SELLER EXPERTS LLC endeavors to ensure continuous access to the Service but reserves the right to temporarily interrupt it for maintenance operations, updates, or in the event of force majeure as defined by general principles of international law (natural disasters, wars, epidemics, widespread network failures, government acts, large-scale cyberattacks). To the fullest extent permitted by applicable law, no liability shall be accepted for indirect, consequential, or incidental damages (data loss, loss of profit, loss of customers, reputational harm) resulting from Service unavailability.
8. User Content
The user is solely responsible for the documents, data, images, and information they import, upload, or enter into the Service. FBA SELLER EXPERTS LLC does not control such content a priori and shall not be held liable for its unlawfulness, inaccuracy, incompleteness, or any infringement of third-party rights (intellectual property, image rights, confidentiality) that it may cause. The user agrees to indemnify FBA SELLER EXPERTS LLC for any claim, action, or judgment resulting from their user content.
9. Photo Studio Module
The Photo Studio module uses third-party image processing APIs. The results obtained (background removal, AI-generated backgrounds, upscaling, retouching) depend on the quality of the images provided by the user and the technical capabilities of the third-party services involved. FBA SELLER EXPERTS LLC does not guarantee that the generated images comply with marketplace requirements or that they are free from visual artifacts.
10. Global Financial Limitation
Notwithstanding any other provision herein, and to the fullest extent permitted by applicable law, the total and aggregate liability of FBA SELLER EXPERTS LLC in respect of any claim arising from or in connection with the use of the Service – whether based on contract, tort (including negligence), product liability, or any other legal theory – is expressly limited to the total subscription fees actually paid by the user during the twelve (12) months immediately preceding the occurrence of the event giving rise to the claim. This limitation does not apply in cases of intentional misconduct, fraud, or where expressly prohibited by mandatory applicable law.
Applicable Law and Jurisdiction
These Legal Notices and any contractual relationship between the user and FBA SELLER EXPERTS LLC are governed by the laws of the State of Delaware (United States), without regard to conflict of law principles.
For users residing in the European Union, Norway, Iceland, Liechtenstein, the United Kingdom, or Switzerland: notwithstanding the above clause, you benefit from the mandatory consumer protection provisions as provided by the law of the country of your habitual residence, which cannot be derogated from by contract. These provisions include, without limitation, the rights conferred by Directive 2011/83/EU on consumer rights and by Regulation (EU) 2016/679 (GDPR).
For users residing in the United States: any dispute shall be resolved exclusively before the state or federal courts located in New Castle County, State of Delaware.
For users residing outside the United States and outside the European Economic Area: any dispute not resolved amicably shall be subject to the exclusive jurisdiction of the courts of New Castle County, State of Delaware, subject to the mandatory consumer protection provisions provided by the law of the user's country of residence.
This choice of law and jurisdiction does not have the effect of depriving the user of the protection afforded by provisions that cannot be derogated from by contract under the law of their country of habitual residence.
Dispute Resolution
In the event of a complaint or dispute relating to the Service, the user is invited to first contact FBA SELLER EXPERTS customer service at contact@fbasellerexpert.com. The company undertakes to examine any complaint in good faith and to seek an amicable solution within thirty (30) days of receipt of the complaint.
For users residing in the European Union: in accordance with Regulation (EU) No. 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform accessible at https://ec.europa.eu/consumers/odr/. However, FBA SELLER EXPERTS LLC is not obliged to participate in an out-of-court dispute resolution procedure before a consumer mediation body and reserves the right to decline such participation on a case-by-case basis.
For users residing in North America: any dispute shall, to the extent permitted by applicable law, be resolved by binding and final arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules in effect at the time. The arbitration shall take place in Wilmington, Delaware, in the English language. The user expressly waives their right to bring or participate in a class action (class action waiver) to the fullest extent permitted by applicable law.
Nothing in these Legal Notices limits the user's right to bring a complaint before the competent supervisory authorities, including data protection authorities (CNIL, ICO, German Länder authorities, etc.), or competent courts in the event of a breach of their rights.
